1. Your initial 50% deposit reserves your event and/or pick up date and is non-refundable.

2. We must receive the balance of the agreed price on or before the pick up date as indicated or the contract is null and void, and the deposit will not be refunded.

3. Seven calendar days before the pick up date is the final date for any change request to the Special Order. Any change request must be made in writing or via email to Marie@ModBaskets.com and the request then becomes part of the contract. 

4. Any change requested after the Special Order is placed cannot be guaranteed and if the request is granted, it will be subject to a 25% additional fee from the agreed price plus the cost of additional materials if any.

5. We do not provide delivery and setup. You must provide for pick up arrangements at our ModBaskets Home, in Sandy, Utah. You can find the address at the footer of any page in the website.

6. There is a window of time of two hours for your agreed pick up time, after which your Special Order will be considered "ABANDONED" and you will be billed at the full agreed price for the Special Order plus fees if any, and we will dispose of the order accordingly.

7. We are not responsible for any damage to the Special Order after it is picked up from our facilities.  You are responsible for providing an appropriate and secure table and environment for the Special Order.  Cakes especially, are heavy and require a sturdy table, and optimal room temperature of 75 degrees Fahrenheit  or below.

8. If flowers or other items are provided by an outside source, we will arrange up to 25 stems or items for free; $1 for each additional item or stem. 

9. Fresh items provided to us by you or your agent are the responsibility of the provider of the items for freshness.

10. You acknowledge that fresh flowers or other items that are not a food products, may contain pesticides, preservatives, insects, dirt, or other contaminants that are not in our direct control.

11. In accordance with The Great State of Utah laws and regulations, we DO NOT provide alcoholic beverages of any kind. If you wish to include such an item as a gift we will help you or your agent place it inside your ModBasket™.

12. The above  is applicable to any other items you are providing to us to be included in the Gift ModBasket™. We prefer you DO NOT send us any items in advance, but sometimes it is unavoidable. We don't want to misplace them, you don't want us to misplace them.

13. When you are providing your own items, please, allow us at least 30 minutes to securely place your item(s) inside the Gift ModBasket™ upon pick up.

14. You agree that we may take photographs of any items that you provide to us as proof of the condition of such items.

15. Once you or your representative picks up and sets up the Special Order, you assume all liability and responsibility for the condition of the Special Order product(s) once it leaves ModBaskets™ possession. 

16. On occasion we will photograph our cakes or Gift ModBaskets™ and we reserve the right to use any photographs for display or promotion without compensation to you.

17. Our products may contain or come into contact with milk, wheat, peanuts, tree nuts, soy, and other allergens. You agree to notify your guests of this risk and hold us harmless for allergic reactions.

18. Performance of this agreement is contingent upon the ability of ModBaskets™ to complete the agreement and is subject to labor disputes or strikes, accidents, Acts of God, and other causes beyond our control.

19. If desired ModBaskets™ can provide a physical or electronic document of these terms and conditions that can be signed by all parties, otherwise the agreed upon Final Order Agreement email becomes the contract, together with these Terms and Conditions.
